Deadline extended for judge selection

Superior Court I Judge Jeffrey Todd granted an extension April 6 for the selection of a special judge for the case involving the City of Marion and a number of parties in relations to missing funds for the Old YMCA renovation project. Todd recused himself after he ruled to merge a related case involving First Farmers Bank & Trust and the city. Todd’s wife works for a local nonprofit organization that has a board member who works for the bank.

Chad Seybold recently changed attorneys and his new attorney, P. Adam Davis, had asked for more time to review the case before selecting another judge. Todd extended the deadline to April 10. Thomas Falkenberg, legal counsel for London Witte, the city’s former financial adviser, said Wednesday no agreement had yet been made between parties on a special judge. If parties cannot agree, a judge will be appointed by the Grant County Clerk of Courts.

The City of Marion will test its tornado sirens at noon Tuesday, weather permitting.
